The future of beach access near SpaceX’s South Texas launch facility — and potentially the viability of its operations there — now rests in the hands of the Supreme Court of Texas.
At issue is Boca Chica Beach, located near the company’s Starbase launch site outside Brownsville. The beach, and the only road leading to it, are frequently closed during rocket launches and testing operations.
Environmental groups argue those closures violate Texans’ right to access public beaches. State officials say they are necessary to protect public safety during launches.
Dispute over public beach rights
The lawsuit was filed by advocacy groups including Save RGV, the Sierra Club and the Carrizo Comecrudo Nation of Texas.
They argue the repeated closures conflict with the Texas Open Beaches Act, which guarantees public access to the state’s coastline.
Plaintiffs say that although the shutdowns are technically temporary, the frequency of launch activity effectively prevents consistent public access to Boca Chica Beach.
Supporters of the lawsuit argue that public land should not be routinely closed to accommodate a private company’s operations.
State says closures are necessary
Texas officials and Cameron County leaders say the closures are legal and essential for safety.
A 2013 state law allows counties to temporarily shut down beaches for spaceflight activities, authority that Cameron County has used to close access during launches and rocket tests.
Officials argue that rockets, debris risks and potential explosions require large safety zones that make keeping nearby public areas open impossible.
They say the Texas Constitution guarantees public beach access overall, but does not require beaches to remain open during dangerous operations.
Potential Impact on SpaceX
The ruling could have significant consequences for SpaceX’s operations at Starbase.
The site serves as the primary testing and launch location for the company’s next-generation Starship rocket system.
Starship is also central to NASA’s Artemis program, which aims to return astronauts to the Moon later this decade.
If the court limits beach closures, launch schedules and testing operations could become far more difficult to manage.
